HOUSTON – The families of two people who were killed in a shooting at the Haverstock Hills apartments in north Houston nearly two months ago filed a lawsuit Friday against the apartment complex.
The shooting happened May 26 at the apartments located on Aldine Bender Lane.
Investigators said an argument between two groups culminated when Kenneth Jones, 35, and his brother Harvey Jones, 34, arrived at the complex. They said Kenneth Jones pulled a rifle from the vehicle he was in and began firing it at the crowd of people.
Gary Rushner, 31, and Christopher Beatty, 33, were killed in the shooting. Two other men and two women were injured.
Kenneth Jones, who was arrested at a home in Florida, was charged with capital murder. He is awaiting extradition to Houston.
Harvey Jones was charged with aggravated assault with a deadly weapon.

The 35-page lawsuit claims that the owners of the apartment complex failed to provide adequate security on the premises, according to court documents.
The lawsuit cites a long history of violence at the property and malfunctioning security equipment as evidence of negligence, according to the documents.
Damages in the amount of $1 million or more are being sought in the suit, according to the documents.
Owners of the property have previously said they are making efforts to improve security.
