A California man is seeking damages after he discovered the son he thought he had buried was still alive.
Frank Kerrigan held a funeral for a man who he thought was his homeless, mentally ill son after police said that he had been identified through fingerprints. It was later found that police actually used an old DMV photo and the man was misidentified.

The family said they had seen the body before the funeral, but the deceased was hard to recognize. The mistake became apparent when the man thought to be dead arrived at the home of a family friend who had attended the funeral.
Kerrigan is asking for upwards of $2 million.
