HOUSTON – Brian Drake, the Cypress Creek High School band director, is accused of having sex with a former student and was removed from campus.

Court records show the Cypress-Fairbanks Independent School District Police Department received a tip on Sept. 16 that Drake had "manipulated" a former Cypress Creek High School student in an inappropriate relationship while she was still enrolled as a student at the school. Police said the tipster claimed Drake was threatening the student by saying he would kill himself if his wife or anyone else found out about their relationship.

The tip included an audio file of a voicemail that Drake left for the student. In the recording, court documents said "Drake told (the student) that he needed her, to have her friend (redacted) send a message to (Drake's) wife stating that he was mistaken. Drake then commented, 'I am going to buy a gun and I'm going to blow my (expletive) brains out. Okay? And that will be your fault, a hundred percent.'"

Investigators said the student initially denied the relationship, but after a forensic analysis of her phone was presented to her, police said the student admitted she had sex with Drake during her senior year.

According to court documents, police said the student admitted to having sex with Drake at her house when her parents weren't home and at his house when his wife wasn't home. 

Another text referred to "operation Brian Drake keeps his job," which the student explained was how the two were vigilant about deleting texts to cover up the relationship.

Court records said Drake initially told investigators that the relationship happened after the student graduated from high school, but when confronted with the text messages between him and the student, police said Drake turned to the investigator and asked, "What do I do?"

Drake's attorney then stopped the interview, according to court documents.

In a statement, Cypress-Fairbanks ISD officials said:

"We were outraged to learn that a Cypress Creek high school teacher was accused of conduct inconsistent of that of a CFISD employee. Due to the seriousness of the allegations, he was immediately removed from the campus, and we will continue to cooperate fully with the investigation by law enforcement. Any compromise to student safety will not be tolerated."
