Border patrol agents found Rivera just a few steps away from crossing the border into Mexico on Monday, and he was initially booked him into the Cameron County jail.
The suspect is charged with capital murder in the death of Carlos Fernandez, the son of his ex-girlfriend.
Rivera was caught just hours after Carlos was laid to rest by his family.
