Witnesses told police the victim had his black Kia Sportage pulled over on the side of the road to replace a tire. As he was placing the defective tire in his trunk, he was hit by a white Lexus RX350.

Paramedics arrived soon after, and the man was pronounced dead at the scene.

The driver of the Lexus, 29-year-old Maggie Anne Louise Webber, remained at the scene after the crash. According to a media release from Houston Police Department, she showed signs of intoxication and was transported to the Harris County Joint Processing Center. She was charged with driving while intoxicated, a charge police say she has received once before.

HPD says the investigation is ongoing.
