With the State Fair of Texas beginning in Dallas in eight days, Texas Attorney General Ken Paxton’s attempts to block the fair’s new gun policy have been denied by a Dallas County district judge.

The State Fair’s new policy limits firearm carriers to elected or employed peace officers throughout all 24 days of the festivities.

Under the previous rules, anyone with a valid handgun license could bring in a firearm as long as it remained concealed.

In a statement from Paxton back in August, he called the State Fair of Dallas’ gun policy “unlawful,” citing a state law that largely prevents local governments from restricting firearms on land they own or lease. He added that the city had “15 days to fix the issue. Otherwise, I will see them in court.”

On Thursday, Dallas County District Judge Emily Tobolowsky said she didn’t believe there was enough evidence to say that laws were being broken by the new restriction.

The ruling means the new policy will be enforced when the fair begins Sept. 27.

The policy change comes after a man wounded three people with a gun during last year’s fair.

State Fair of Texas President Mitch Glieber said the judge’s ruling he believes the new policy will help keep the fair’s attendees safe.
