Texas AG Ken Paxton files last-minute appeal to stop State Fair of Texas from implementing gun ban

DALLAS, Texas – Texas Attorney General Ken Paxton has filed an appeal with a court asking them to stop the City of Dallas and the State Fair of Texas from imposing a firearm ban on the property.

The fair implemented the policy after a man wounded three people in a shooting at last year’s fair.

Last week, a Dallas County district judge denied Paxton’s request seeking to block the implementation of the policy.

In a statement from Paxton back in August, he called the State Fair of Texas’ gun policy “unlawful,” citing a state law that largely prevents local governments from restricting firearms on land they own or lease. He added that the city had “15 days to fix the issue. Otherwise, I will see them in court.”

Dallas County District Judge Emily Tobolowsky said she didn’t believe there was enough evidence to say that laws were being broken by the new restriction.

On Monday, Paxton filed an appeal.

“The City of Dallas and the Texas State Fair are not above the law, and we are seeking emergency relief to uphold Texans’ Constitutionally-protected Second Amendment rights,” said Paxton. “The State Fair’s policy—by which law-abiding citizens could not defend themselves—does not make the environment safer, it merely gives an advantage to criminals looking for victims.”

The State Fair of Texas opens on Friday, Sept. 27. Unless Paxton’s appeal is granted, the policy will be enacted once the fair opens.
