Lawsuit filed against Height’s bar, following man’s death in 2022

Almost two years since a 26-year-old man was found in the Houston Ship Channel, the man’s family is now filing a wrongful death lawsuit.

Houston – Almost two years since a 26-year-old man was found in the Houston Ship Channel, the man’s family is now filing a wrongful death lawsuit.

Delano Burkes was found in the water in November 2022.

Now, his family is claiming negligence on the part of a bar in the Heights.

Burkes’ family says the last place he was seen or heard from was at McIntyre’s on 20th St.

The lawsuit, which was filed on Friday, claims the bar overserved alcohol to Burkes and forcibly removed him from the establishment, knowing he was intoxicated.

It goes on to say staff knew Burkes needed assistance to “prevent serious injury or death” and that he couldn’t make it back to his home or anywhere else, safely.

They say McIntyre’s failed to “implement” and “monitor” policies to keep customers safe.

Burkes went missing on November 13th. After that, the search was on, with Texas Equusearch even getting involved. It wasn’t until November 25th when tugboat employees found his body in the Houston Shipchannel.

The family is seeking more than a million dollars.
