Additional charges filed against former Cy-Fair ISD teacher accused of having sex with student on multiple occasions

HOUSTON – New charges have been filed against a former teacher at Cypress-Fairbanks Independent School District accused of having sex with a student on multiple occasions

Kayden Burbank, 29, was booked into the Harris County Jail after he was arrested and initially charged with improper relationship with a student.

What’s new?

According to court documents, two more charges have been filed against Burbank related to the case. He now faces two counts of sexual assault of a child under 17 years of age.

What happened?

According to court documents, a Cypress-Fairbanks ISD police officer spoke with a woman who reported that Burbank had engaged in sexual activity with a student two times. The woman said she knew this because Burbank’s girlfriend had told her about the alleged relationship between Burbank and the student.

Court documents say Burbank’s girlfriend found out about the relationship after going through his phone and finding text messages between Burbank and the student.

When his girlfriend confronted Burbank, he allegedly told her the relationship was with a 15-year-old student of his.

Police were able to speak to the student who told them on Feb. 7, Burbank told her that he liked her. The student said Burbank gave her his phone number on Feb. 20. The student said later, that Burbank and her kissed in a classroom and had sex, according to the court documents.

The court documents said the student’s father spoke to officers and he signed a consent form for them to search through data on her cell phone.

The documents said on April 2, officers spoke with Burbank who told them he had been texting with the student. He told officers he had taken the student through a Popeyes restaurant drive-through and the two ate lunch together, but said there weren’t any physical interactions between them.

The documents said Burbank signed a consent form for police to extract his cell phone data. He later came to pick up the phone after the data was extracted and Miranda warnings were read to him. Following that, Burbank told police he wanted to speak to them without an attorney, but changed his mind and said he didn’t want to speak more without an attorney present.

A forensic interview was done with the student and she allegedly told authorities that she and Burbank had engaged in sexual activity, one day in a classroom. The documents said the student told authorities that Burbank had given her a pass to leave her second-period class that day and meet him in a classroom. She allegedly told police the same day, Burbank picked her up across the street after school and they had sex.

The student said on another occasion, Burbank picked her up across from the school and parked at another location and the two engaged in sexual activity.

The documents said the student told police Burbank had reserved a hotel room on March 25 and the two of them had sex in the room. The student couldn’t remember the name of the hotel, but said it was eight minutes away from the school.

The student allegedly said the sexual activity “began at 3:50 PM and finished at 4:22 PM.” After that, the student told authorities she and Burbank sat and cuddled before getting dressed and going back to the school.

Police were able to discover which hotel and obtained a copy of a receipt from the owner confirming Burbank had reserved a room on the date the student said the activity occurred. Text messages recovered by police also confirmed the incident had taken place.

Police were also able to review school security footage showing the student had left her second-period class and gone to the classroom she said she had went to meet Burbank.

Cypress-Fairbanks ISD released a statement on Burbank’s arrest:

Mr. Kayden Burbank, a former teacher at Cy-Fair High School, resigned on April 9, 2024. Mr. Burbank was placed on administrative leave on April 2, 2024, pending a complete investigation by campus administration and law enforcement, after campus administration was made aware of allegations of an improper relationship between an educator and student.
