The mistrial of the sentencing phase means a new jury will have to be assembled to consider Temple’s sentence. The second trial was ordered after an appeals court overturned Temple’s original 2007 murder conviction on the grounds of prosecutorial misconduct. Temple’s attorneys filed a motion last week asking the judge to toss out the second conviction altogether and conduct a completely new trial. The judge denied that request Wednesday.

He has been convicted of murder in this case before and most recently in August 2019 for the second time. The judge said Temple is entitled to bail under the law and set it at $1 million. Special prosecutors were appointed by a judge in 2017 to review the case and decide whether Temple would be tried again. If granted a new trial, it would be the third time he stands trial in the same case.
