HOUSTON – The death of a little boy in Kingwood, specifically what to do with his body, has sparked a contentious battle in court between a former NFL player and the boy's mother.
Danny Josiah Ware, 3, died Friday after being hit by a vehicle driven by a family friend.
Police said the tragic mishap appeared to be an accident.
Ware's father is Danny "D.J." Ware, a former NFL running back who lives in Atlanta, and won two Super Bowl rings with the New York Giants.
The boy's mother has filed a temporary restraining order to block Ware's attempt to move his son's body to Atlanta.
The court document appears to reveal problems between the deceased 3-year-old's mother and father.
"Plaintiff and her son recently came to Houston, Texas, to get away from a negative and unhealthy situation in Georgia with the estranged husband, Danny Ware," the document read.
For now the body of Danny Josiah Ware, known as Josiah, remains at a Houston funeral home after a temporary restraining order was issued Monday.
A hearing is scheduled for Feb. 15.
